Terms of Service

Welcome to Flip Focus (“we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of the Flip Focus mobile application and related services (collectively, the “Service”). These Terms form a binding agreement between you and Cosmos Mind Labs, the provider of Flip Focus.

By downloading, accessing, or using Flip Focus, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

1. Eligibility

You must be at least 13 years old to use Flip Focus. By using the Service, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms.

2. Description of Service

Flip Focus is a productivity application that helps you run timed focus sessions, reduce distraction, and track your concentration habits. Features include starting a focus session by placing your device face down, blocking distracting applications for the duration of a session, session plans and presets, notifications and live session status, and a history of your completed sessions with related statistics.

Flip Focus is a productivity aid only. It is not a medical, therapeutic, or diagnostic tool, and it is not a substitute for professional advice of any kind. We may modify, suspend, or discontinue any part of the Service at any time without prior notice.

3. Your Device and Your Data

Flip Focus does not require you to create an account. Your session history, preferences, and settings are stored locally on your device.

Because this data is stored on your device, it is your responsibility to maintain it. Deleting the app, resetting your device, or losing your device may permanently erase your Flip Focus data. We cannot recover data stored only on your device.

4. Device Permissions

Flip Focus requests certain permissions in order to function:

• Screen Time / Family Controls (iOS) and Accessibility and Usage Access (Android) are used solely to identify and block distracting applications during an active focus session.
• Notifications are used to deliver focus reminders, session alerts, and progress updates.
• Device motion sensors are used to detect when your device is placed face down in order to start or maintain a session.

These permissions are used only to deliver the features described above. They are never used to read your personal messages, capture passwords, monitor sensitive personal activity, or sell your data. You may revoke any permission at any time through your device settings, though doing so may disable the related features.

5. Acceptable Use

• You agree not to:
• Use the Service to harass, abuse, or harm others.
• Use the Service for any unlawful purpose.
• Attempt to gain unauthorized access to our systems.
• Interfere with the operation or security of the Service.
• Reverse engineer, decompile, disassemble, copy, or create derivative works from the Service, except to the extent this restriction is prohibited by applicable law or permitted by the license terms of any open-source components included in the app.

6. Subscriptions and Payments

Flip Focus is free to download and includes core functionality at no cost. Free use is subject to limits, which currently include a maximum number of focus sessions per day, a maximum session length, a limited number of sessions with app blocking enabled, and a limited window of session history.

Flip Focus Pro is an auto-renewing subscription that removes these limits and unlocks additional features.

• The subscription name, duration, and price are displayed in the app before you complete any purchase, and are also shown on your App Store product page.

• Payment is charged to your Apple ID or Google Play account at confirmation of purchase.

• Your subscription renews automatically at the then-current price for the same period unless you cancel it at least 24 hours before the end of the current period.

• Your account is charged for renewal within 24 hours prior to the end of the current period.

• You can manage or cancel your subscription at any time in your device’s account settings: on iOS, Settings → your name → Subscriptions; on Android, Google Play → Payments & subscriptions. Cancelling stops future renewals; it does not retroactively refund the period already in progress.

• Any unused portion of a free trial period, where offered, is forfeited when you purchase a subscription.

• Prices may change in future. Where required by law, we or the applicable app store will give you notice and the opportunity to cancel before a changed price takes effect.

• All refunds are handled by the app store through which you purchased, in accordance with that store’s refund policy. We are not able to issue refunds for purchases made through the App Store or Google Play.

7. Intellectual Property

The Service, including its software, design, branding, logos, content, and features, is owned by Cosmos Mind Labs and protected by applicable intellectual property laws. Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use Flip Focus for your own personal, non-commercial purposes. Except as expressly permitted, you may not copy, distribute, modify, create derivative works from, or otherwise use our intellectual property without written permission.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.

9. Third-Party Services

Flip Focus uses Superwall to present subscription offers and manage subscription status. Purchases are processed by Apple or Google, not by us.

These third parties operate under their own terms and privacy policies, and we are not responsible for their content, policies, or practices. You agree to comply with any applicable third-party terms when using the Service.

10. Service Availability

We strive to provide a reliable service but do not guarantee uninterrupted availability. The Service is provided on an “as is” and “as available” basis, with all faults and without warranties of any kind, whether express, implied, or statutory, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Some jurisdictions do not allow the exclusion of implied warranties, so this exclusion may not apply to you.

11. Limitation of Liability

To the fullest extent permitted by law, Cosmos Mind Labs and its affiliates, officers, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, including loss of data or loss of profits, however caused and regardless of the theory of liability.

Our total liability for any claim related to the Service shall not exceed the greater of the amount you paid us, if any, during the twelve months preceding the claim, or fifty United States dollars (US $50.00).

Some jurisdictions do not allow the limitation of liability for personal injury or for incidental or consequential damages, so this limitation may not apply to you.

12. Indemnification

You agree to defend, indemnify, and hold harmless Cosmos Mind Labs from and against any claims, damages, liabilities, losses, and expenses arising from your use of the Service, your violation of these Terms, or your violation of the rights of another person or entity.

13. Termination

These Terms remain in effect until terminated by you or by us. Your rights under these Terms terminate automatically if you fail to comply with any of their provisions. We may suspend or terminate your access to the Service at any time if we reasonably believe you have violated these Terms or engaged in conduct that may harm the Service or its users. You may stop using the Service at any time by deleting the app.

14. Changes to These Terms

We may update these Terms from time to time. When changes are made, we will update the “Last updated” date above. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of Nigeria, without regard to its conflict of law principles. Nothing in this section deprives you of the protection of mandatory consumer protection laws of the country in which you reside.

17. Additional Terms for Applications Obtained Through the Apple App Store

The following additional terms apply to your use of Flip Focus if you obtained it from the Apple App Store. In the event of a conflict, this Section 17 controls with respect to the Apple App Store version of the app.

1. Acknowledgement. These Terms are concluded between you and Cosmos Mind Labs only, and not with Apple Inc. (“Apple”). Cosmos Mind Labs, not Apple, is solely responsible for Flip Focus and its content.
2. Scope of License. The license granted to you for Flip Focus is a non-transferable license to use Flip Focus on any Apple-branded products that you own or control, and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that Flip Focus may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing.
3. Maintenance and Support. Cosmos Mind Labs is solely responsible for providing any maintenance and support services with respect to Flip Focus, as specified in these Terms or as required under applicable law. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to Flip Focus.
4. Warranty. Cosmos Mind Labs is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of Flip Focus to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to Flip Focus, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be the sole responsibility of Cosmos Mind Labs.
5. Product Claims. Cosmos Mind Labs, not Apple, is responsible for addressing any claims by you or any third party relating to Flip Focus or your possession and use of it, including but not limited to: (i) product liability claims; (ii) any claim that Flip Focus fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation, including in connection with Flip Focus’s use of any applicable frameworks.
6. Intellectual Property Rights. In the event of any third-party claim that Flip Focus or your possession and use of it infringes that third party’s intellectual property rights, Cosmos Mind Labs, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
7. Legal Compliance. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
8. Developer Name and Address. Questions, complaints, or claims with respect to Flip Focus should be directed to Cosmos Mind Labs at the address and email address set out in Section 16 above.
9. Third Party Terms of Agreement. You must comply with applicable third-party terms of agreement when using Flip Focus.
10. Third Party Beneficiary. You acknowledge and agree that Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms, and that upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary of these Terms.

By using Flip Focus, you acknowledge that you have read, understood, and agree to these Terms of Service.
